Going Beyond the Bylaws

Leaders In Community Association Law Representing Condominium, Homeowner, and Cooperative Associations

Our Community Association Group provides our clients with practical and strategic legal guidance on every aspect of Community Association Law. From day-to-day operations to multimillion dollar construction defect litigation and everything in between, we stand ready to guide community associations through all their legal challenges.

We become an integral part of our clients‘ professional team.

Services Include:

COLLECTIONS
Assessments are generally an association’s sole source of revenue for such critical functions as property maintenance, snow removal, capital improvements and security.  We provide a full range of cost-effective collection services designed to achieve maximum recovery.

GENERAL COUNSEL
We provide legal counsel to the officers and directors of an association board on risk management and operations of the association, including:

  • Legal opinions analyzing the association’s governing documents
  • Contract review, negotiation and drafting
  • Responses to Fair Housing Act questions
  • Amendments to the governing documents
  • Guidance on issues concerning board governance

TRANSITION FROM THE DECLARANT OR SPONSOR
Transition is the process during which control of a community association transfers from the Declarant/Sponsor to the unit owners. This process is perhaps the most important event for an association to experience during its formation. Attorneys from the Horn Williamson community association and construction groups work closely and collaboratively to hold builders accountable for construction deficiencies. We ensure the transition process is completed in an efficient and effective manner.

COVENANT AND RULE ENFORCEMENT
The covenants, conditions, and restrictions set forth in the governing documents of community associations were created to maintain property values, promote harmony among residents and otherwise ensure that these communities are attractive places to live. We are adept at assisting boards to identify and implement effective enforcement strategies of these community rules and covenants.

LITIGATION
When litigation cannot be avoided, we stand ready to facilitate the best possible resolution. Drawing on our collective and multi-faceted experience, our team is well prepared to effectively advance our clients’ interests. While we strive to resolve matters prior to trial, we are no strangers to the courtroom and are known for our zealous and creative advocacy.
